Overview

A video exchange licence authorizes retailers or businesses to rent or sell videos, DVDs and/or video games to the public.

Eligibility

All retailers or businesses that rent or sell videos, DVDs and/or video games to the public must obtain a video exchange licence issued by the Department.

To obtain a video exchange licence, businesses must submit a completed application and pay the applicable fees.

Description

The two categories of video exchange licenses are based on the number of titles available for purchase or rent, not on the number of copies of the same title available:

Class "A" Video Exchange Licence: required by retailers if the video exchange carries 300 or more videofilm or video game titles.

Class "B" Video Exchange Licence: required by retailers who carry less than 300 video film and/or video game titles.

- A business that holds a video exchange licence will receive a Film and Video Classification Catalogue and, if applicable, rating stickers to place on the videos and DVDs from the Department. Titles that have received a classification from the Canadian Home Video Rating System (CHVRS) are accepted through legislation by the Province.

- All videofilm and video games must be obtained through a distributor licensed in New Brunswick.

- In Canada, movie ratings are a provincial and territorial responsibility. The Nova Scotia Maritime Film Classification Board classifies English titles and Québec classifies all French titles. Video games that have received a classification from the Entertainment Software Rating Board (ESRB) are accepted through legislation by the Province.

- Videos and DVDs are classified to assist consumers decide if a particular movie is suitable and also to allow viewers to make an informed choice. Stickers marked with the specific classifications are affixed to the videos or DVDs prior to distribution to the consumer.

The Department employs inspectors who routinely ensure that retail outlets possess a current video exchange licence and all videofilm or video games being sold or rented have the proper classification displayed on the product.
