Overview

Fees are payable to the Clerk of the Small Claims Court, pursuant to Subsection 71(1) of the the General Regulation under the Small Claims Act, for the filing of documents in the Small Claims Court and for services rendered by the Office of the Clerk.

Eligibility

Solicitors or self-represented litigants who are parties to proceedings in the Small Claims Court in any of the eight judicial districts in New Brunswick.

Description

The Small Claims Court hears actions for debt, damages, and/or the return of personal property for an amount up to $20,000. Claims are heard by an adjudicator (an experienced lawyer) and the process is somewhat less formal than regular court processes.

The Small Claims Court is governed by the Small Claims Act and the General Regulation under the Act. There are specific forms that must be used in the Small Claims Court.

Unless otherwise specified, Fees exclude the harmonized sales tax (HST).
